New Version of Form I-485 Becomes Mandatory on December 23, 2022

On December 13, 2022, USCIS published a draft of the new version of Form I-485 to its website. The new edition has been published for preview only. USCIS notes that the new version of Form I-485 will not be accepted until December 23, 2022. Additionally, USCIS advises that any application utilizing the updated version will be rejected if filed before December 23, 2022.

Furthermore, given the time it takes for new edition dates to be populated into software, age-out issues, and priority date retrogression, among other things, AILA has further reached out to USCIS to request guidance on compelling rejections if edition date July 15, 2022, is filed after December 22, 2022. However, AILA recommends that members plan to submit only the December 23, 2022, edition once it becomes required until more information is received.
