Employment-Based 5 Visas (EB-5)
EB-5 “Immigrant Entrepreneur” immigrant visas are available to individuals from any country if they invest in a new commercial enterprise that will create full-time employment for at least 10 other U.S. residents.
There are two categories of investors under the EB-5 program: 1.) individuals investing $500,000 or more in targeted high-unemployment areas and 2.), individuals investing at least $1,000,000 anywhere in the U.S.
The information and documentation our firm requires for the preparation and processing of the EB-5 visa application include the following:
- Articles of Incorporation for the U.S. company
- By-Laws, Shareholders Agreements, Share Certificates, and other Relevant Corporate Documents
- Sample Publications, Marketing Materials, and Advertising Materials from the U.S. company
- Sample Invoices, Contracts, etc. establishing the Nature of the Business Activity and showing a Regular Course of Trade
- Twelve Months of Bank Accounting Records for the U.S. company
- Notarized Copies of the Beneficiary’s Passport
- Occupational license/Permit/Zoning Documents (if applicable) for the U.S. company
- Proof of opening a U.S. Bank Account
- Lease for the U.S. company location
- I-9 Forms and Payroll Records, evidencing that there is a minimum of ten employees in the U.S. company
- Notarized Copies of Front and Back of I-94 (if the Beneficiary is in the U.S. during processing of application)
- Foreign Address of the Beneficiary
- Present Address of the Beneficiary
- Social Security Number (if applicable)
- Job Title and Description of Duties
- Salary and other Compensation (e.g. health insurance)
- Photos of all properties, inside and out, pertaining to the U.S. company
- Gross and Net Annual Income of the U.S. company
- Income Tax Returns of the U.S. company
- Description of the Stock Ownership of the U.S. company
- If applicable, a letter from an authorized body of sate government which certifies that a particular geographical or political subdivision within a non-rural area qualifies as an area of high unemployment
